1. Who you're contracting with

These Terms govern your use of Curate Presence (the "Service"), provided by Curate Presence ("we", "us", "our"). By using the Service you agree to these Terms. If you're using the Service on behalf of an organization, you confirm you have authority to bind it.

2. The Service

Curate Presence is a tool that generates social media content (captions, story ideas, reels prompts, hashtags and CTAs) for small businesses. We do not guarantee that the Service will be uninterrupted, timely, error-free, or that generated content will be accurate or suitable for your purposes — you are responsible for reviewing outputs before publishing.

You must provide accurate information, keep your credentials confidential, and are responsible for all activity under your account. You must be of legal age in your jurisdiction to use the Service.

Outputs are generated by automated models and may contain inaccuracies. You are responsible for your prompts, how you use outputs, verifying accuracy, and ensuring you have the rights to any input you provide. Outputs are not legal, financial, medical, or other professional advice. We may filter, refuse, or remove outputs and may suspend accounts for repeated or serious policy violations. If you believe an output infringes your rights, contact us and we will review and act where appropriate.

6. Intellectual property

We retain all rights in the Service, including its software, models, branding, and documentation. We grant you a limited, non-exclusive, non-transferable right to use the Service for your business under your active plan. Subject to your compliance with these Terms, you own the outputs you generate, but you may not claim ownership over the underlying model or imply endorsement by us.

7. Payments, subscriptions and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Billing, taxes, renewals, cancellations and refunds are governed by Paddle's Buyer Terms. See our Refund Policy for refund eligibility.

8. Suspension and termination

We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated policy violations. You may stop using the Service at any time by cancelling your subscription via the Paddle customer portal. On termination, your right to use the Service ends; we may delete account data after a reasonable period.

9. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the extent permitted by law, our aggregate liability arising out of or related to the Service is limited to the amounts you paid to us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence, or any liability that cannot be excluded by law.

11. Indemnity

You will indemnify us against third-party claims arising from your inputs, your use of outputs, or your breach of these Terms.

12. Changes

We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which Curate Presence is established, without regard to conflict-of-laws principles. Disputes will be resolved in the competent courts of that jurisdiction.
